Terms of agreement

1.1. General Provisions and Validity

These terms and conditions apply to all orders placed in Latvian, Russian, and English on the online store Darkwood.lv (hereinafter referred to as the ONLINE STORE). The contract is concluded between the BUYER (the person placing the order) and Darkwood.lv (hereinafter referred to as the SELLER). These terms have been in effect since May 1, 2019.


1.2. Distance Contract

A distance contract is a legally binding agreement between the CONSUMER and the SELLER, established under the Consumer Rights Protection Law of Latvia (PTAL). The contract is formed through:

  • An advertisement or offer (e.g., catalog, printed materials, press advertisements, TV, radio, email, website, telephone, fax).
  • The CONSUMER placing an order via an online store, telephone, or other communication channels.

1.3. Contract Formation

The distance contract comes into effect when:

  1. The CONSUMER places an order through the ONLINE STORE, phone, or another method.
  2. The SELLER confirms the order via email.

Both the order and confirmation are considered received when they are made available to the parties involved.


1.4. Order Fulfillment

  • The SELLER commits to fulfilling the order within 30 days of receiving it unless another deadline has been agreed upon.
  • If the ordered goods are out of stock, the SELLER must inform the CONSUMER. In such cases, the SELLER may offer:
    • An equivalent product at the same price.
    • A refund if no alternative product is accepted.

1.5. Right of Return

Under the Consumer Rights Protection Law of Latvia, the CONSUMER has the right to cancel the distance contract within 14 calendar days and return the purchased goods.

Important Information:

  • The CONSUMER has 24 months from the purchase date to file a claim for non-compliance with the stated product parameters.
  • The right of return does not apply in cases where:
    • The product cannot be returned due to its nature (e.g., hygiene items, electric shavers).
    • The product packaging has been opened (applies to hygiene items, perishable goods, and software, audio, or video products).
    • The expiration date of the product has passed.
  • The CONSUMER is responsible for maintaining the quality and safety of the goods during the return period.

1.6. Return Procedure

To return a product, the CONSUMER must provide proof of purchase.

  • The product must be returned within 14 calendar days if it complies with the distance contract terms.
  • If the product does not comply with the distance contract terms, the CONSUMER must:
    • Fill out a statement of claim form in accordance with Cabinet of Ministers Regulations of the Republic of Latvia No. 631.
    • Return the product in full configuration with all original components.
